1. Acceptance of Terms

By accessing or using www.iswimband.com (the “Site”), purchasing an iSwimBand device, or installing the iSwimBand mobile application (collectively, the “Services”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please refrain from using the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make purchases. By using the Services on behalf of a minor, you confirm that you are their legal guardian and accept these Terms on their behalf.

3. Safety Disclaimer

iSwimBand is NOT a life-saving device and is NOT a substitute for competent adult supervision. Always maintain direct sight and reach of children and at-risk swimmers. Misuse or reliance solely on the device may result in serious injury or death.

4. Orders, Payments & Shipping

All prices are listed in U.S. dollars unless stated otherwise. We accept major credit cards and digital wallets via our secure checkout. Estimated shipping times are provided at checkout and may vary by destination. Title and risk of loss pass to you upon delivery.

5. Returns & Limited Warranty

You may return undamaged products within 30 days of delivery for a full refund, minus shipping fees. Devices are warranted against manufacturing defects for one (1) year from purchase. This warranty excludes normal wear, misuse, and water damage beyond the device’s stated depth and duration limits.

6. User Accounts & Conduct

You agree to:

• Provide accurate, up-to-date information;
• Maintain the confidentiality of your login credentials;
• Refrain from: (a) reverse-engineering the software, (b) uploading malicious code, (c) infringing third-party rights, or (d) using the Services for unlawful purposes.

We may suspend or terminate accounts that violate these Terms.

7. Intellectual Property

All content on the Site—logos, text, graphics, firmware, app code, and blog articles—is owned by iSwimBand or its licensors and protected by international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Privacy

Our Privacy Policy, incorporated by reference, explains how we collect, use, and disclose data. By using the Services, you consent to such processing.

9. Third-Party Links

The Site may contain links to external websites. iSwimBand is not responsible for the content or practices of those sites and provides links solely for convenience.

10. Limitation of Liability

To the fullest extent permitted by law, iSwimBand, its officers, employees, and suppliers shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, personal injury, or property damage, arising out of or related to the use—or inability to use—the Services, even if advised of the possibility.

11. Indemnification

You agree to indemnify, defend, and hold harmless iSwimBand from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of the Services; (b) violation of these Terms; or (c) infringement of any intellectual property or other rights.

12. Termination

We may terminate or suspend your access at any time, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties. Sections 5 – 13 survive termination.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of Kochi, Kerala. You waive any objection to venue or jurisdiction.

14. Changes to Terms

We may revise these Terms at any time by posting an updated version on the Site. Material changes will be notified via email or prominent notice at least 10 days before they take effect. Continued use after the effective date constitutes acceptance.
